The FCC released a Public Notice on January 17, 2008 listing procedures and giving guidance to 800 MHz, non-border, licensees who need to request a waiver of the June 26, 2008 deadline for completion of 800 MHz rebanding.

 

Key decisions are as follows:

 

 

§         They have worked diligently and in good faith to complete rebanding expeditiously

§         The additional time requested is no more than is reasonably necessary to complete the rebanding process.

 

 

§         System size and complexity.

§         Interoperability.

§         Steps already taken towards completion

§         A proposed timetable which includes steps necessary for completion, along with the dates these steps will be completed

 

 

 

 

§         Waves 1 and 2 must file by March 17, 2008.

§         Waves 3 and non-border Wave 4 must file by April 15, 2008.

 

 

§         FRA (Frequency Reconfiguration Agreement with Sprint Nextel) negotiations are not complete.

§         New channels will not be cleared by Sprint Nextel before June 26, 2008.

§         Implementation will not be able to be completed by June 26, 2008.
